These Terms & Conditions apply to enquiries, proposals, bookings and event-related services supplied by GuestAgenda in Australia, unless different written terms are agreed in a signed proposal, invoice or service agreement.
1. Definitions
GuestAgenda, we, us or our means the event service provider. Client, you or your means the person or business requesting, booking or receiving our services.
2. Services
We provide event-related services including planning, coordination, styling direction, supplier liaison, entertainment-led event formats and related support for corporate events, private events and poker-party style experiences. The exact scope of services is the scope set out in the accepted quote, proposal or invoice.
3. Quotes and bookings
Quotes are based on the information available at the time of preparation. A booking is only confirmed when the client accepts the relevant quote or proposal and any required deposit, booking fee or other confirmation step has been completed.
4. Fees and payment
Fees, deposits, payment stages and due dates are those stated in the accepted proposal, invoice or booking confirmation. Late payment may delay delivery, supplier confirmations, scheduling or event execution.
5. Client responsibilities
The client is responsible for:
- providing accurate and timely information about the event
- reviewing quotes, timelines, inclusions and approvals carefully
- obtaining venue permissions where the client controls the venue relationship
- ensuring guest numbers, timing and access details are reasonably accurate
- making payments by the agreed due dates
- ensuring the event, venue and guest conduct comply with applicable laws, venue rules and safety requirements
- promptly notifying us of changes that may affect planning, cost or delivery
6. Service provider responsibilities
GuestAgenda is responsible for:
- performing the agreed services with due care and skill
- communicating the agreed scope, key steps and known delivery requirements
- making reasonable efforts to coordinate booked service elements within the confirmed scope
- notifying the client of material issues we become aware of that may affect delivery
- providing services substantially in line with the accepted proposal, subject to approved changes, venue conditions and circumstances beyond reasonable control
7. Changes to scope
If the client requests changes to guest numbers, format, venue, timing, styling, suppliers, entertainment or other material aspects of the event, we may revise the price, schedule, inclusions or delivery plan. No changed scope is confirmed until accepted by both parties.
8. Third-party suppliers
Some services may involve third-party venues, vendors, contractors or technology providers. Where external suppliers are involved, availability, performance, timing and specific third-party terms may affect delivery. We are not responsible for every act or omission of third parties outside our reasonable control.
9. Cancellations and postponements
If a booking is cancelled or postponed, fees already paid may be applied against work already performed, committed supplier costs, reserved dates, administration and other non-recoverable amounts. Any specific cancellation structure set out in the accepted proposal or invoice will apply to that booking.
10. Venue and access conditions
Delivery depends on practical venue conditions including access times, loading access, lifts, stairs, staffing restrictions, bump-in windows, sound limitations, furniture rules, permit requirements and local conditions. The client must disclose material venue restrictions known to them.
11. Poker-party and entertainment formats
Poker-party style services are supplied as entertainment-led event formats unless otherwise expressly stated in writing. The client is responsible for ensuring that the intended use of the event format is lawful and suitable for the venue, attendees and event purpose.
12. Photos and promotional use
Unless the client and GuestAgenda agree otherwise in writing, we may photograph or reference non-confidential aspects of event setup or styling for portfolio, gallery or promotional use, provided we act reasonably and avoid unnecessary disclosure of sensitive personal or commercial information.
13. Liability
To the maximum extent permitted by law, GuestAgenda is not liable for indirect, consequential or special loss, loss of profit, loss of opportunity or reputational loss arising from the services. Nothing in these Terms excludes rights that cannot lawfully be excluded, including rights under the Australian Consumer Law.
14. Consumer rights
These Terms are intended to operate alongside any mandatory rights and remedies that apply under Australian law. Nothing in these Terms removes, restricts or excludes rights that cannot legally be excluded.
15. Force majeure
We are not responsible for delay or failure caused by events beyond reasonable control, including severe weather, venue closure, supplier failure outside reasonable control, accidents, emergency restrictions, transport disruption, utility failure or similar external events.
16. Governing law
These Terms are governed by the laws of Victoria, Australia, unless mandatory consumer law requires otherwise.
17. Updates
We may update these Terms from time to time. The version published on the website applies from its effective date, unless separate written terms govern a specific booking.
